1. Acceptance of Terms

By accessing or using the website and services of 1865 Free Money ("we," "our," or "us"), a web design and app development agency based in Buford, Georgia, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Services.

2. Description of Services

1865 Free Money provides custom website design, web development, and mobile app development services for small businesses. Our services include but are not limited to:

• Custom website design and development starting at $250
• Mobile app development starting at $750
• Website redesigns and updates
• Domain setup and hosting guidance
• SEO-optimized website structure

3. Pricing & Payment

3.1 Service Pricing

Our base pricing is $250 for a complete 5-page custom website and $750 for app development. Additional pages, features, or custom functionality may incur additional charges, which will be communicated and agreed upon before work begins.

3.2 Payment Terms

Payment terms and methods will be agreed upon before project commencement. We may require a deposit before beginning work. Final payment is due upon project completion and your approval of the delivered work.

3.3 Additional Costs

Domain registration (approximately $12/year) and web hosting (approximately $5-15/month) are separate costs paid directly to third-party providers. We will help you set these up but these are not included in our design fee.

4. Project Delivery

4.1 Timeline

Most websites are delivered within 7-10 business days from when we receive your content (text, images, branding materials). Timelines may vary based on project complexity and client responsiveness in providing materials and feedback.

4.2 Client Responsibilities

You are responsible for providing all content for your website, including text, images, logos, and any other materials. Delays in providing content may extend the delivery timeline.

4.3 Revisions

Our base package includes a reasonable number of revisions during the design process. Extensive revisions or changes to the project scope after initial approval may result in additional charges.

5. Ownership & Intellectual Property

Upon full payment, you own the completed website including all custom code, design elements, and content. You are free to host, modify, and maintain your website as you see fit. You are never locked in to our services.

We retain the right to display the completed project in our portfolio and reference it as an example of our work, unless you explicitly request otherwise in writing.

6. Website Content

You are responsible for ensuring that all content you provide for your website (text, images, logos, etc.) does not infringe on any third-party intellectual property rights. You agree to indemnify us against any claims arising from content you provide.

7. Use of Our Website

By using our website at 1865freemoney.com, you agree to:

• Use the website only for lawful purposes
• Not attempt to interfere with the website's operation or security
• Not submit false or misleading information through our contact forms
• Not use automated systems or bots to submit forms or scrape content

8. Disclaimer of Warranties

OUR WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE OPERATION OF OUR WEBSITE OR THE RESULTS OF OUR DESIGN SERVICES. WHILE WE STRIVE TO DELIVER HIGH-QUALITY WORK, WE CANNOT GUARANTEE SPECIFIC BUSINESS OUTCOMES, SEARCH ENGINE RANKINGS, OR TRAFFIC RESULTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 1865 FREE MONEY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OUR WEBSITE OR SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

10. Termination

Either party may terminate a project agreement by providing written notice. If you cancel a project after work has begun, you are responsible for payment for work completed up to the date of cancellation. We reserve the right to refuse service to anyone for any reason.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of our website and services after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts located in Gwinnett County, Georgia.

13. SMS and Text Messaging Terms

These terms govern the text-messaging programs of the applications we own and operate, including BladeBook, an appointment-booking app for barbershops operated by 1865 Free Money LLC.

• Consent. You opt in by entering your mobile number in the app while booking an appointment, joining a walk-in waitlist, or checking in on the web kiosk. Consent is given directly to 1865 Free Money LLC at the phone field, where this disclosure is shown: "By entering your number you agree to receive text messages from BladeBook about this visit: appointment updates and walk-in waitlist status from your barber. Msg frequency varies (about 1-6 per visit). Msg & data rates may apply. Reply HELP for help, STOP to opt out. See Terms and Privacy Policy." Consent is never bundled into another agreement, and there is no pre-checked box. A mobile number is required only because these appointment notifications are how the booking service is delivered. Consent to PROMOTIONAL messages is never a condition of purchasing anything: re-booking reminders require a separate checkbox at the phone field that is unchecked by default, and leaving it unchecked has no effect on your booking.
• Message types and frequency. Messages appointment-related: running-late notices from your barber and walk-in waitlist position updates, plus a one-time opt-in confirmation the first time a number joins the program. Re-booking reminders are promotional and are sent only if you enrolled in a recurring schedule AND ticked the separate re-booking checkbox. Expected frequency is approximately 1 to 6 messages per appointment cycle; frequency varies.
• Fees. Message and data rates may apply according to your mobile carrier plan. Carriers are not liable for delayed or undelivered messages.
• Opting out and help. Reply STOP at any time to unsubscribe; you will receive one final confirmation of your opt-out. Reply HELP for help, or contact us at oouchie@1865freemoney.com.
• No third-party sharing. We do not share, sell, rent, or trade your mobile phone number or your messaging consent with third parties or affiliates for their marketing or promotional purposes. See our Privacy Policy for full details on how messaging data is handled.
