LinguaKids Terms of Use (EULA)

These Terms of Use are the end user license agreement ("EULA") between you and 1865 Free Money LLC ("we," "us") for the LinguaKids app on iOS and Android. By creating an account or using LinguaKids you agree to these terms and to the LinguaKids Privacy Policy. If you do not agree, do not use the app.

LinguaKids is for children using it with a parent or legal guardian. The account must be created and managed by a parent or guardian, who accepts these terms for themselves and the child and is responsible for the child's use of the app.

We grant you a personal, non-exclusive, non-transferable, revocable license to use LinguaKids on devices you own or control, for your family's personal, non-commercial learning. You may not copy, modify, resell, reverse engineer, or attempt to extract the app's source code or content, or use the app to break the law or to harm others.

LinguaKids is free to download. Optional auto-renewing monthly subscriptions unlock more features:

• Basic — 1 month, auto-renewing — 3 video chats and 3 roleplays daily, basic pronunciation feedback.
• Premium — 1 month, auto-renewing — unlimited video chats and roleplays, full pronunciation feedback.
• Family — 1 month, auto-renewing — Premium for up to 4 child profiles.

The current price for your country is shown in the app and in the App Store or Google Play before you confirm a purchase.

• Payment is charged to your Apple ID or Google Play account when you confirm the purchase.
• The subscription renews automatically each month at the same price unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• Manage or cancel on iPhone/iPad in Settings → [your name] → Subscriptions, or on Android in the Google Play Store app → Profile → Payments & subscriptions → Subscriptions. Deleting the app does not cancel a subscription.
• Cancelling stops future renewals; you keep access until the end of the period you already paid for.
• Refunds are handled by Apple or Google under their refund policies; we cannot issue refunds for store purchases.
• If we change a subscription price, Apple or Google will notify you as their rules require before the new price applies.

Some features use artificial intelligence to generate Luna's replies, corrections and report cards. These features are off until a parent turns them on. AI responses are generated automatically and can occasionally be inaccurate or unexpected; they are a learning aid, not professional instruction. Please supervise your child's use, and report any inappropriate response to us so we can fix it.

You keep any rights you have in what your child types or says in the app, and you give us permission to process it only to provide the app as described in the Privacy Policy. You are responsible for keeping your sign-in details secure. You can delete your account at any time in Profile → Delete Account.

These terms are between you and us, not Apple or Google. Apple and Google are not responsible for the app or its content, have no obligation to provide maintenance or support, and are not responsible for any claims relating to the app. If the app fails to conform to an applicable warranty, you may notify Apple or Google, which may refund the purchase price under its policies; to the maximum extent permitted by law they have no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms for iOS users and may enforce them. You confirm you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.

LinguaKids is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, and our total liability for any claim relating to the app is limited to the amount you paid us for the app in the 12 months before the claim. Nothing in these terms limits rights you have under consumer-protection law that cannot be limited.

We may update these terms; the date above shows the latest version, and continued use after a change means you accept it. We may suspend accounts that misuse the app. You may stop using the app and delete your account at any time.

These terms are governed by the laws of the State of Georgia, United States.
